Town of Badin Ordinance 95-3
ORDINANCE REGULATING ACTIVITIES ON PARKS AND PLAY GROUNDS OWNED OR OPERATED BY THE TOWN OF BADIN
WHEREAS, the Town Council of the Town of Badin deems it to be in the best interest of the health and public safety of the citizens of the Town of Badin to regulate activities on parks and play grounds owned or operated by the Town of Badin;
THEREFORE, BE IT ORDAINED by the Badin Town Council as follows:
Section One: It shall be unlawful for any person to consume malt beverages or unfortified wine or to have in his or her possession an open container of malt beverage or unfortified wine on any park or play ground in the Town of Badin owned, occupied or controlled by the Town of Badin. The possession, consumption and transportation of fortified wine and spirituous liquor shall be governed by Chapter 18B of the General Statutes of North Carolina and other applicable law.
Section Two: For purposes of this Section "malt beverages", "unfortified wine", and "opened containers", "fortified wine" and spirituous liquor" are as defined in Chapter 18B of the General Statutes of North Carolina.
Section Three: It shall be unlawful for any person to transport onto or to possess any glass bottle, glass jar or other glass container on any park or play ground in the Town of Badin owned, occupied or controlled by the Town of Badin.
Section Four: When the Badin Town Council has established the hours of the day the Town's public parks or play grounds shall be opened and closed to the public use and shall have caused the hours of opening and closing to be posted in a conspicuous place at the respective, parks or play grounds, be unlawful for anyone to go upon the premises of the parks or play grounds during the time when they are closed to the public use.
Section Five: It shall be unlawful for any person to have any motorized vehicle on any park or play ground, except for park maintenance, in the Town of Badin owned, occupied or controlled by the Town of Badin.
Section Six: It shall be unlawful to park vehicles, trailers, etc., overnight on any park or play ground in the Town of Badin owned, occupied or controlled by the Town of Badin.
Section Seven: When the Badin Town Council has established rules and regulations pertaining to the use and operation of the Town's public parks or play grounds, and shall have caused the rules and regulations to be posted in a conspicuous place at the respective parks and play grounds, it shall be unlawful for anyone to disobey those rules and regulations.
Section Eight: Violation of this Ordinance shall constitute a Class 3 misdemeanor and shall be punishable by a fine of up to Fifty Dollars. Each Violation shall constitute a separate offense.
Section Nine: This Ordinance may be enforced by any officer of the Badin Police Department or any other law enforcement officer.
Section Ten: This Ordinance shall be effective upon passage.
This Ordinance was duly passed by the Badin Town Council on the 12th day of December, 1995.
