Town of Badin Ordinance 99-7

AN ORDINANCE AMENDING AND RESTATING AN ORDINANCE PROHIBITING COMMERCIAL TRUCK PARKING AND ANYTHING NOT SELF-PROPELLED ON TOWN OF BADIN STREETS

WHEREAS, the Town Council of the Town of Badin deems it to be in the best interest of the health and safety of the citizens of the Town of Badin to prohibit commercial truck parking, (a commercial truck being defined as any vehicle over 8,000 lbs. that is used for any type of commercial enterprise), and anything not self-propelled on the streets in the Town of Badin, and

WHEREAS, this Ordinance is enacted pursuant to the provisions of Article 15, specifically including Sections 160A-296 and 160A-300, of the General Statutes of North Carolina and other applicable law;

THEREFORE, BE IT ORDAINED by the Badin Town Council as follows:

Section 1: It shall be unlawful to park or leave standing within a residential zone, any commercial truck or trailer on any street from 6:00 pm to 6:00 am.

Section 2: It shall be unlawful to park or leave standing within a residential zone, anything not self-propelled on any street overnight.

Section 3: Vehicles left parked or standing in a prohibited area as a result of an emergency stop shall not be in violation of this Ordinance.

Section 4: This Ordinance shall not apply to trucks actively delivering or receiving merchandise from a residence.

Section 5: Any person, firm or corporation violating the provisions of this Ordinance, shall be guilty of a misdemeanor, punishable by a fine of $25.00.

Section 6: This Ordinance shall be in full force and effect upon passage.

This Ordinance was duly passed by the Badin Town Council on the 14th day of December, 1999.
